The Hatch Act does not apply to U.S. uniformed service military personnel, although it does apply to Department of Defense officials, as well as Department of Homeland Security officials who directly support the U.S. Coast Guard. Members of the U.S. Armed Forces are subject to Department of Defense Policy 1344.10 (DoDD 1344.10), the political activities of members of the Armed Forces, and the spirit and intent of this policy is virtually the same as that of the Hatch Act for federal public servants. By agreement between the Secretary of Defense and the Secretary of Homeland Security, DoDD 1344.10 applies at all times to uniformed Coast Guard personnel, whether serving in the Department of Homeland Security or as part of the Department of Defense Navy. As an indication, DoDD 1344.10 is considered to belong to the same category as an order or regulation, and military personnel who violate its provisions may be considered a violation of section 92 (non-compliance with orders or regulations) of the Uniform Code of Military Justice.
